TERMS & CONDITIONS

Welcome to Designed By Shakeira. By purchasing services, visiting this website, or engaging in any project, you agree to these Terms & Conditions. These terms are designed to outline the rights and responsibilities of both the client (“you”) and Designed By Shakeira (“Company,” “I,” “me,” or “my”) and to ensure a smooth and professional working relationship.

1. Services Provided

I provide graphic design, branding, website design, content creation, and related creative services. The specific scope of work, deliverables, file formats, and timelines will be detailed in the service description, invoice, or proposal provided before work begins.

2. Payments

  • All projects require full or partial payment (as outlined in the invoice or product listing) before work begins.

  • Accepted payment methods will be provided at the time of booking or checkout.

  • Late or missed payments may delay delivery or pause work until payment is received in full.

3. Refund Policy

  • Full Refund Eligibility – A full refund is available if an email request is sent to designedbyshakeira@gmail.com within 24 hours of purchase.

  • After 24 Hours – Refunds are at my discretion and will typically not be issued due to the immediate purchase of design resources and project preparation. If granted, refunds will not exceed 50% of the total payment.

  • Non-Refundable Circumstances – Refunds will not be issued once substantial work has been completed, design resources have been purchased, or custom work has begun.

4. Client Responsibilities

To ensure the project progresses smoothly, you agree to:

  • Provide all required content, brand assets, and instructions by the agreed deadlines.

  • Respond promptly to emails, proofs, and revision requests to avoid delays.

  • Ensure that all materials provided (logos, images, fonts, etc.) are owned by you or are properly licensed for use.

  • Understand that delays in providing materials or approvals will extend project timelines.

5. Revisions

  • Each service includes a set number of complimentary revisions (as stated in the service description).

  • Revisions are limited to changes in fonts, colors, text, and minor layout adjustments unless otherwise agreed.

  • Additional revisions beyond the included amount will be billed at the current rate per revision.

6. Ownership & Usage Rights

  • Upon final payment, you will receive the agreed rights to use the final deliverables for the intended purpose (e.g., branding, marketing).

  • Designed By Shakeira retains the right to display completed work in my portfolio, on my website, and in marketing materials unless otherwise agreed in writing.

  • Original working files (e.g., PSD, AI, or layered files) are not included unless purchased separately.

7. Timelines & Delivery

  • Project timelines begin once all required materials and payment have been received.

  • Delivery dates are estimates and may be adjusted for unforeseen delays.

  • Final files will be delivered via email, secure download link, or other agreed delivery method.

8. Client Communication & Deliverables

  • If required project materials or approvals are not received within 5 business days, the project will be paused and a restart fee of $50 will be required to resume work.

  • If there is no contact for 14 consecutive days, the project will be canceled automatically and all payments made will be forfeited.

  • A new order and full payment will be required to restart the project.

9. Hourly Services & Travel Fees

  • Hourly service rates apply to any work billed by the hour, including consultations, design time, and revisions beyond included amounts.

  • For in-person work requiring travel outside of Oak Ridge, Tennessee, a travel fee will be added to the invoice.

  • Travel fees will cover reasonable transportation, accommodation (if required), and other related expenses necessary to complete the work on location.

  • All travel arrangements and associated costs will be discussed and approved prior to invoicing.

10. Professional Conduct & Respect

  • All communication between the client and Designed By Shakeira must remain professional, respectful, and constructive.

  • Abusive language, harassment, discrimination, or disrespectful behavior of any kind will not be tolerated.

  • If such behavior occurs, the project will be terminated immediately and no refunds will be issued.

11. Limitation of Liability

  • Designed By Shakeira is not responsible for business outcomes, sales results, or performance after delivering the work.

  • I am not liable for any damages, losses, or claims resulting from the use or misuse of the delivered designs.

12. Cancellations

  • If you cancel a project after work has begun, the refund policy applies.

  • If I cancel a project due to unforeseen circumstances, a pro-rated refund will be issued for any work not completed.

13. Compliance With Policies

By working with Designed By Shakeira, you agree to also comply with the Privacy Policy and Refund Policy, which form part of these Terms & Conditions.

14. Governing Law

These Terms & Conditions are governed by the laws of the state of Tennessee, without regard to its conflict of law principles.
